By placing an order or using our website, you agree to these Terms of Service. Please read them carefully before making a purchase.
2. Definitions
"We," "us," and "our" refer to Alien Mood / thedawn. "You" and "your" refer to you, the customer. "Products" refers to all physical goods available for purchase on our website. "Website" refers to alienmood.com (or your actual domain).
3. Eligibility
You must be at least 16 years old to make a purchase. By placing an order, you confirm that the information you provide is accurate and complete, and that you are legally capable of entering into a binding agreement.
4. Products & Descriptions
We make every effort to display our products and their colours as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the actual colour or detail of a product. Minor variations between the product image and the actual item are not considered defects.
All products are made to order and produced specifically for you after purchase.
5. Pricing & Payment
All prices are listed in your local currency where available and include VAT for EU customers. Prices are subject to change without notice, but changes will not affect orders that have already been confirmed.
We accept the payment methods displayed at checkout. Payment is processed at the time of order. Your order is only confirmed once we have received full payment.
We are not responsible for any additional fees charged by your bank or payment provider, including but not limited to currency conversion fees.
6. Orders & Order Confirmation
When you place an order, you are making an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraudulent activity.
Once your order is confirmed, you will receive a confirmation email. This email constitutes our acceptance of your order and the formation of a binding purchase agreement.
7. Production & Shipping
All products are made to order. Please refer to our Shipping Policy for current processing times and estimated delivery windows.
Risk of loss and title for products pass to you upon delivery by the carrier to your address. We are not responsible for delays caused by carriers, customs processing, or events beyond our control.
8. Right of Withdrawal (EU & UK Customers)
If you are located in the European Union or the United Kingdom, you have the legal right to cancel your order within 14 calendar days of receiving your product, without giving a reason.
To exercise this right, you must notify us by email before the 14-day period expires. After notification, you have an additional 14 days to return the item. Full details, conditions, and exceptions are outlined in our Return & Refund Policy.
This right of withdrawal does not apply to custom or personalized orders.
9. Returns & Refunds
Our full Return & Refund Policy is available on our website and forms part of these Terms of Service. Key points:
EU & UK customers have a 14-day legal right of withdrawal. US & Canada customers: all sales are final. No returns for change of mind. Defective or incorrect items are covered for all customers within 30 days of delivery. You do not need to return defective items.
10. Intellectual Property
All content on this website — including but not limited to designs, graphics, logos, the Alien Mood name, mascot imagery, product images, text, and website layout — is the property of TheDawn / Alien Mood or its licensors and is protected by intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our content without our prior written permission. Purchasing a product does not grant you any rights to our intellectual property beyond personal use of the physical item.
11. User Conduct
When using our website, you agree not to use the site for any unlawful purpose, attempt to gain unauthorized access to any part of the website, interfere with the website's functionality or security, submit false information during checkout or account creation, or use automated tools to scrape, copy, or extract content from our website.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Alien Mood / TheDawn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website or products, including but not limited to loss of profits, data, or goodwill.
Our total liability for any claim arising from an order shall not exceed the amount you paid for that specific order.
This limitation does not affect your statutory rights as a consumer under EU, UK, or other applicable law. Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
13. Force Majeure
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, supply chain disruptions, government actions, or carrier delays.
14. Privacy & Data Protection
We process your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable privacy laws. Please refer to our Privacy Policy for full details on how we collect, use, store, and protect your data.
15. Third-Party Services
Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of these external sites. Your use of third-party services is at your own risk and subject to their terms and conditions.
We use third-party service providers for payment processing, order fulfillment, and shipping. While we select these partners carefully, we are not responsible for their actions or omissions beyond our reasonable control.
16. Governing Law & Disputes
These Terms of Service are governed by and construed in accordance with the laws of the Netherlands.
EU customers: If you are a consumer residing in the EU, you also benefit from any mandatory provisions of the consumer protection law in your country of residence. You may bring legal proceedings in the courts of your country of residence or in the Netherlands. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.
UK customers: If you are a consumer residing in the UK, you benefit from mandatory provisions of UK consumer protection law. Disputes may be brought before the courts of England and Wales, Scotland, or Northern Ireland, depending on where you reside.
US & Canada customers: Any dispute arising from these terms or your use of our website shall be governed by Dutch law. You agree that the courts of the Netherlands shall have jurisdiction, except where prohibited by local law.
17. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Continued use of the website after changes are posted constitutes your acceptance of the revised terms. Material changes affecting existing orders will not apply retroactively.
